30 years serving clients · 47,000+ bankruptcies filed firmwide · Local Dothan office

Let’s Start With What Is Happening Right Now

Maybe the credit cards have become impossible to keep up with. Maybe your paycheck is being garnished, your vehicle is at risk of repossession, or you are behind on the mortgage. Or maybe there is no single emergency—you simply cannot see a realistic way to pay everything you owe.

Bankruptcy can stop lawsuits, foreclosures, repossessions, and wage garnishments.

Financial problems can build gradually or arrive all at once. Whatever brought you here, the important question is what options you have now.

Bankruptcy may offer a way to address those problems, but Chapter 7 and Chapter 13 work differently and neither is right for everyone.

Our first job is not to talk you into filing. It is to look at your income, debts, property and goals and explain the options that may actually fit your situation. If bankruptcy makes sense, we’ll help you understand what to expect and guide the case through the process.

You do not have to figure out bankruptcy alone. Brock & Stout has helped Alabama families with Chapter 7 and Chapter 13 since 1996, has filed more than 47,000 bankruptcy cases firmwide, and has a longstanding office right here in Dothan.

    Five-Star Reviews

47,000+ is a firmwide historical total, not cases filed only in Dothan. The review count is firmwide and is not limited to bankruptcy matters. Measured by consumer debtor filings in the State of Alabama. This is not a claim that Brock & Stout is better than other consumer bankruptcy law firms. Past filings do not guarantee a result in any case.

We Explain the Options Before You Decide

Bankruptcy is an important decision. We want you to understand the difference between Chapter 7 and Chapter 13, what may happen to your debts and property, and what questions need to be answered before you file.

What Is Bringing You Here?

People come to our Dothan office for many reasons—job loss, medical bills, divorce, a lawsuit, or debt that simply grew faster than the paycheck. We start with the problem that is keeping you up at night.

Credit Card or Medical Debt

If unsecured debt has become impossible to manage, Chapter 7 or Chapter 13 may provide relief depending on your overall financial situation.

Debts in bankruptcy

Vehicle Repossession

Bankruptcy can stop a repossession. Chapter 13 can also help address missed vehicle payments.

Foreclosure

Bankruptcy can stop a foreclosure. Chapter 13 can also give you a way to catch up missed mortgage payments over time.

Foreclosure

Debt That Simply Is Not Sustainable

You do not need to wait for a lawsuit, garnishment or repossession before talking with us. If the numbers no longer work, a bankruptcy consultation can help you understand what options exist.

Could Chapter 13 Help?

Chapter 13 is a court-supervised repayment process for individuals with regular income. You propose a plan—usually lasting three to five years—that provides for payments to a Chapter 13 trustee, who distributes money to creditors according to the confirmed plan.

Chapter 13 can be useful when someone needs time to deal with certain debts, wants to address missed mortgage or vehicle payments, has property concerns that make Chapter 7 less attractive, or does not qualify for Chapter 7.

Not every creditor is necessarily paid in full. How much must be paid depends on the types of debt, income, property, applicable bankruptcy rules and the terms the court confirms.

Chapter 13 may be worth discussing if:

  • You are behind on a mortgage and want to explore keeping the home
  • You are behind on a vehicle loan
  • You are facing garnishment or other collection activity
  • You have debts that Chapter 7 may not address the way you need
  • Your income or other circumstances make Chapter 13 a better fit
  • You have property you are concerned about protecting

No one factor automatically makes someone eligible. We look at the whole picture.

Could Chapter 7 Help?

Chapter 7 is the form of bankruptcy many people think of when they hear the phrase “fresh start.” In an individual Chapter 7 case, qualifying debts can be discharged so the debtor is no longer personally responsible for paying them.

But Chapter 7 does not erase every debt, and filing does not automatically mean every asset is at risk—or automatically protected. Eligibility, exemptions, liens and the types of debt you owe all matter.

Common unsecured debts that may be dischargeable can include credit-card balances, medical bills, personal loans and some judgments, depending on the circumstances.

Chapter 7 may be worth discussing if:

  • Most of your problem debt is unsecured
  • Your income and circumstances may qualify under Chapter 7 rules
  • You need relief from collection activity
  • You do not have a realistic way to repay your unsecured debt
  • You want to understand how Alabama exemptions may apply to your property

Chapter 7 or Chapter 13?

The better chapter depends on the whole financial picture—not simply which option sounds easier.

What Happens at a Free Bankruptcy Consultation?

You do not need to know whether you should file Chapter 7 or Chapter 13 before calling us. That’s one of the reasons for the consultation.

1. Tell Us What’s Going On

We’ll ask about the debts causing the biggest problems, your income, property and any urgent collection activity.

2. We Look at the Options

We’ll discuss whether Chapter 7, Chapter 13 or another course may make sense based on the information you provide.

3. We Explain the Tradeoffs

Bankruptcy has benefits, requirements and consequences. We want you to understand those before making a decision.

4. You Decide What to Do

A consultation does not obligate you to file bankruptcy. If you decide to move forward with Brock & Stout, we’ll explain what information we need and what happens next.

What Happens to Collection Activity When Bankruptcy Is Filed?

Filing bankruptcy can stop lawsuits, garnishments, foreclosure activity, and repossession efforts. That relief comes from the automatic stay, which generally begins when a case is filed.

Our Knowledge Center explains how the stay works and when it may not apply.

Filing Bankruptcy in Dothan, Alabama

Bankruptcy is governed primarily by federal law, but Alabama law can affect important issues such as exemptions—the rules that determine what property may be protected. Alabama has opted out of the ordinary federal bankruptcy exemption list, so Alabama statutes usually control that analysis.

Dothan is part of the Middle District of Alabama’s Southern Division. The bankruptcy court has a Dothan location serving Coffee, Dale, Geneva, Henry and Houston counties. Which division applies depends on where the debtor lives, not which Brock & Stout office is contacted.

Our attorneys handle these local filing and court requirements as part of the case.
