Social Security Disability Insurance is based on work you did in jobs covered by Social Security. You generally need enough Social Security work credits for your age and when your disability began, plus a medical condition that meets SSA’s disability rules.
The credit requirement is not a single 10-year rule. Younger workers may qualify with fewer credits. Other workers generally need both enough total credits and enough recent work. A diagnosis by itself is not a decision, and being unable to return to your last job is not the whole test.
Covered Foley-area work can still produce credits, or not, depending on timing. We look at the earnings record instead of guessing from a job title.
Supplemental Security Income is a needs-based program with income, resource and other nonmedical rules. Unlike SSDI, you do not need your own history of Social Security work credits.
SSI can apply to people with limited income and resources who are disabled, blind or age 65 or older and meet the program’s other requirements. For an adult applying based on disability, SSA generally uses the same medical disability standard used for SSDI. Some people may qualify for both programs.
If you have limited income and resources and little covered work, SSI may be the program to examine. We can help you compare it with SSDI.
Our Foley disability team can help manage the evidence, forms, Social Security communications, deadlines, appeals, and hearing preparation involved in your claim.
Depending on the stage of the claim, our team may:
If that is the help you need, we can start with a free consultation.
Social Security Disability is a federal program, so these attorneys can represent claimants at hearings nationwide. Each profile is maintained in our attorney directory.
