We Explain Before You Decide

We’ll explain how Chapter 7 and Chapter 13 work, what each option may accomplish, and the important limitations you should understand before deciding whether to file.

Debt Problems We Help North Alabama Clients Address

Our Huntsville bankruptcy team helps clients facing credit-card and medical debt, wage garnishment, lawsuits, overdue house or vehicle payments, and other financial pressures.

Unsecured Debt That Outgrew Income

Credit cards, medical bills, and personal loans are common reasons people call. Many qualifying unsecured debts may be dischargeable. Some debts are not.

Debts in bankruptcy

Wage Garnishment

Filing generally triggers the automatic stay and can pause many garnishments while the stay remains in effect. Exceptions apply, including some based on prior filings.

Garnishment and the stay

A House at Risk

Chapter 13 may sometimes help eligible homeowners address mortgage arrears over time while ongoing payments continue. We do not promise that a home can be saved.

Foreclosure questions

A Vehicle at Risk

Bankruptcy can affect repossession activity. Chapter 13 may help with missed vehicle payments in some cases. Recovering a vehicle already taken depends on timing and facts.

Repossession issues

Lawsuits and Collections

The automatic stay generally pauses most collection lawsuits and collection activity while it remains effective. It does not pause every possible proceeding.

You Do Not Have to Wait for a Crisis

If your income no longer covers your debts, a free consultation can help you understand whether bankruptcy may be an option. You do not need to wait for a lawsuit.

Chapter 7 for Madison County Clients

Chapter 7 can discharge many types of qualifying unsecured debt. Eligibility rules apply, Alabama exemptions affect how property is treated, and some debts cannot be discharged.

  • Unsecured debt is the main problem
  • Chapter 7 eligibility needs to be checked
  • Applicable exemption law affects the property analysis
  • Some debts may remain after discharge

When Chapter 13 May Be a Better Fit

Chapter 13 is a court-supervised repayment process, generally three to five years, with payments to a Chapter 13 trustee. Unsecured creditors are not necessarily paid in full.

Chapter 13 is often considered when someone is behind on a house or vehicle, or when income or property makes Chapter 7 a poor fit.

  • Eligible mortgage or vehicle arrears may be addressed in the plan
  • Ongoing payments must remain affordable
  • The confirmed plan determines how unsecured creditors are treated
  • The court has to confirm the plan

How Bankruptcy Can Affect Collection Activity

Filing bankruptcy generally triggers the automatic stay, which can pause many lawsuits, foreclosure actions, repossessions, and wage garnishments. Exceptions, prior filings, timing, and the status of any sale or repossession can affect the protection.

Madison County and the Northern Division

Bankruptcy is primarily federal law. For many Alabama residents, Alabama exemption law governs the property analysis, although residency history can affect which state’s exemptions apply.

Madison County is in the Northern District of Alabama’s Northern Division. As of October 1, 2025, that division’s office is in Huntsville, with hearings in Huntsville and Florence. The office you visit does not determine venue. Venue generally depends on where the debtor has lived or been domiciled during the applicable period, with other rules for businesses, assets, and related cases. What Bankruptcy Clients Say About Brock & Stout

Brock & Stout has received more than 8,000 five-star reviews firmwide. The comments below are from bankruptcy clients who shared their experiences with our team.

The only bankruptcy lawyer in mobile to actually talk to me and they said you have to have a lot of money to file bankruptcy and you will still lose everything and be homeless. I guess bankruptcy is just a scam the rich people use to hide profit. It was a nice view from their office windows though. Sorry you had to deal with a lower class old married couple looking for help. Didn't realize we would be wasting your time, we actually thought bankruptcy was a real thing.

Hello Hoover Community! I wanted to share a difficult life decision with my financial affairs. I have been in a terrible struggle since my divorce in 2012 with anything to do with money. Doing extra for my kids past the child support, cars, car fixes, house maintenance and NOT even a vacation! I am 62 and tired. I sought how the bankruptcy process would work for me after talking to at least 6 “debit consolidation” companies where you pay them so much a month and when you have money in their account they start to pay creditors 50 cents on the dollar. The problem is “legal protection”. They don’t guarantee or offer it for an individual. Bankruptcy for some reason is a bad term in financial woes and trying to get future loans. I found Brock and Stout and they have been WONDERFUL! Actually Google A.I. said they were the best in my area of Hoover with a 5.0 so I called them. A.I. was correct! I schedule an appointment for their remote location and met Destini. She was awesome. I am retired Military so I had all the proper paperwork desired to get a quick start as some of my monthly payments were getting behind. Than the lawyer and Julie. A fantastic team and process which only took 6 working days. I did have all the paperwork which helped 100% with that timeline. Today is 8 Oct 2026 and at this moment I don’t have any “STRESS”, “Anxiety” which I have carried since 2012. It’s beautiful! I was advised for Chapter 13 and I still keep my house. I can afford the monthly payments and still live with confidence. If you are reading this and are in financial stress call Brock and Stout Hoover/Bham locations and get started for stress relief. I have a 5 year payment plan. The debit consolidation stuff you see on social media is ALL A SCAM! They end up taking 20-30 percent of your money and NO LEGAL PROTECTION! Call Brock and Stout today with ALL your financial challenges and if your monthly payments are piling up behind! 100%. Salute!!
