Short answer
Alabama personal injury claims are decided under Alabama law. In many negligence cases, if the injured person is found even slightly at fault, recovery can be barred. That is a different system from Georgia. This page explains concepts. It does not tell you the date a complaint must be filed.
If the crash or injury happened in Alabama, start here rather than copying a Georgia article. The Code of Alabama and Alabama courts supply the rules. We link official sources instead of restating every section. For crash facts see car accidents. For process see how claims work.
Fault
Contributory negligence is the idea that a plaintiff’s own carelessness can bar recovery if it contributed to the injury. Insurers in Alabama often look for any argument that you share blame. Whether that defense applies is a fact question. Do not assume you have “no case” because an adjuster said you were partly at fault, and do not assume you win because the other driver got a ticket.
Damages and UM
Economic losses and non-economic losses are both claimed when the law allows. Punitive damages, when available, require extra proof. UM/UIM is first-party coverage; see uninsured motorists. Premises and dog-bite facts still sit inside these fault rules unless a more specific statute applies.
Wrongful death
Alabama names who may bring a wrongful death action and what the recovery is for. That is not the same list as Georgia. See wrongful death and talk with counsel about probate and personal-representative issues.

Frequently asked questions
Personal injury claims are subject to filing deadlines, and the deadline that applies can depend on the facts of the case. Different notice requirements may apply depending on who is involved. Do not use this website to calculate a filing deadline. Speak with an attorney promptly.
No. Georgia uses a modified comparative system described on the Georgia hub. Alabama generally treats contributory negligence as a bar in ordinary negligence cases. Do not mix the two.

If another driver’s negligence caused a crash, you may have a claim against that driver and available insurance. Your own policy can also matter, including uninsured motorist coverage. This page does not calculate a filing deadline or a settlement value.
- Georgia Personal Injury Law — Georgia Personal Injury Law
Georgia personal injury claims generally reduce recovery by the plaintiff’s percentage of fault. If that percentage is high enough under O.C.G.A. § 51-12-33, recovery can be barred. That is not Alabama’s contributory-negligence rule. This page does not calculate a filing date.
- Slip and Fall Injury Claims — Slip and Fall Injury Claims
You may have a claim if a property owner or occupier failed to use reasonable care and that failure caused your fall. Wet floors, broken stairs, poor lighting, and unmarked hazards are common fact patterns. Falling is not enough by itself. The owner’s knowledge of the hazard often matters.
- Uninsured and Underinsured Motorists — Uninsured and Underinsured Motorists
Uninsured motorist coverage may apply when the at-fault driver has no liability insurance, or in a hit-and-run that the policy covers. Underinsured coverage may apply when that driver’s limits are too low for the injuries. You generally have to have bought the coverage. Notice requirements in the policy can be strict.
- Wrongful Death Claims — Wrongful Death Claims
A wrongful death claim is a lawsuit authorized by statute when a death is alleged to have been caused by someone else’s wrongful act. Who may file, and what damages the law allows, depends on the state. Grief is not the same as legal standing.
