Georgia Bankruptcy Exemptions Explained

The OCGA § 44-13-100 list

Last updated September 18, 2026

Short answer

Georgia provides a categorized exemption list. Homestead, vehicle, household goods, and a wildcard are the lines people ask about most. Read the current OCGA text for amounts. Some federal retirement protections still apply on top.

Unlike Alabama’s more compact personal-property statute, Georgia itemizes. That can be better for a modest car and household goods and a wildcard leftover—or worse if a category is maxed. Stacking is a schedule-drafting issue. Child pages cover homestead and vehicle.

How Brock & Stout can help

We map each asset to a § 44-13-100 paragraph and choose Chapter 7 or 13 based on leftover non-exempt value. We do not guarantee the trustee will agree with values.
